The strait is <\/span><a href=\"https:\/\/www.justsecurity.org\/133996\/legal-operational-strait-hormuz-transit-passage\/#:~:text=All%20vessels%20and%20aircraft%E2%80%94military%20and%20civilian%E2%80%94have%20the,of%20UNCLOS%20and%20applicable%20customary%20international%20law.\"><span>governed<\/span><\/a><span> by the 1982 United Nations Convention on the Law of the Sea (UNCLOS), which guarantees the right of passage for all ships and aircraft through the vital waterway, even in times of war.<\/span><\/p>\n<figure id=\"D-ROS-B2\" class=\"a9d\"><\/figure>\n<figure id=\"M-ROS-B2\" class=\"a9d\"><\/figure>\n<p><strong><em>RELATED:&nbsp;What Navy? Footage Shows Obliteration of Islamist Regime\u2019s Ships<\/em><\/strong><\/p>\n<p><span>UNCLOS has long existed in an even more nebulous state than most of what passes for \u201cinternational law,\u201d having been accepted or signed but not ratified by various states, including both the United States and Iran. Most of the international community takes it seriously, but hostile powers like Iran have violated it before, most famously in the case of China <\/span><a href=\"https:\/\/www.breitbart.com\/national-security\/2016\/07\/07\/7-jul-16-world-view-south-china-sea-tension-set-escalate-july-12-arbitration-ruling\/\"><span>disregarding<\/span><\/a><span> a 2016 tribunal ruling it disagreed with and using force to claim the South China Sea.<\/span><\/p>\n<p><span>There is no recognized international law that <\/span><a href=\"https:\/\/www.ntu.ac.uk\/about-us\/news\/news-articles\/2026\/03\/expert-blog-what-legal-right-does-iran-have-to-close-the-strait-of-hormuz#:~:text=What%20international%20law%20says,would%20be%20difficult%20to%20justify.\"><span>gives<\/span><\/a><span> Iran the right to attack civilian ships in the Strait of Hormuz, or level taxes and tolls against them. The two nations bordering the Strait to the south, Oman and the United Arab Emirates (UAE), also have no right to control the vital waterway. Iran also has no legal right to plant mines in the Strait, as it has frequently threatened to do over the years.<\/span><\/p>\n<p><span>Iran has made some effort to skirt around these legalities by claiming its attacks are only directed against ships belonging to its military enemies, the United States and Israel, but of course \u201cinternational law\u201d tends to become vaporous during any conflict.<\/span><\/p>\n<p><span>The <\/span><i><span>South China Morning Post <\/span><\/i><span>(SCMP) on Friday <\/span><a href=\"https:\/\/www.scmp.com\/economy\/china-economy\/article\/3347337\/strait-hormuz-tensions-flare-iran-tightens-grip-over-shipping-traffic\"><span>reported<\/span><\/a><span> that Iran is \u201crolling out screening processes and steep transit fees\u201d for ships seeking safe passage through the Strait of Hormuz.<\/span><\/p>\n<p><span>Meanwhile, the International Maritime Organization (IMO) is trying to establish a \u201csafe maritime framework\u201d to evacuate merchant ships trapped in the Persian Gulf by the Strait shutdown.<\/span><\/p>\n<p><span>\u201cI am ready to start working immediately in negotiations to establish a humanitarian corridor to evacuate all vessels and seafarers trapped,\u201d said IMO Secretary General Arsenio Dominguez at a special session on Thursday.
